How to interpret these figures
The collection changed in 2023. Refusal percentages use all requests received, including those awaiting a decision or withdrawn. Decision timeliness uses the source’s decision cohort. Requests, assessments and issued plans are not the same annual cohort.
Annual reviews expected in 2025 can have been completed during 2025, completed earlier, or not recorded as completed. Missing and suppressed local-authority data remains unavailable; it is not zero.
The publisher changed the appealable-decision methodology to use completed annual reviews. These rates follow the current download and must not be spliced into older appeal-rate series.
An appeal rate measures appeals registered against appealable decisions. It is not the percentage of appeals won or a prediction for a child. Blank, suppressed and unavailable source cells are not zero.
English EHC plan and SEND tribunal procedures do not apply to Welsh individual development plans.

Practical help: send, ehcp and education appeals
A delay, a refusal to assess and disagreement with the contents of a plan are different problems. Use the council data for context, then check the route for the actual decision. English EHC plans and Welsh individual development plans operate under different systems.
Identify the decision being challenged
Keep the council’s decision letter, the date it was received and the plan or assessment documents. Note whether the issue is a refusal to assess, a refusal to issue a plan, a plan’s contents, a school placement or a failure to carry out an action. A complaint about delay is not automatically the same as a tribunal appeal.
Check mediation and appeal requirements
The official guidance explains when mediation advice or a certificate is required and when an exception applies. Check the decision-specific time limit and the correct appeal form. Do not assume that an ongoing complaint or discussion with the council extends that time limit.
Organise a focused evidence pack
Gather the decision, relevant plan sections, professional reports, school evidence and the child or young person’s views. Create a chronology of requests and responses. Ask an adviser what evidence addresses the particular disagreement and what the tribunal can decide.
Use local independent support
The SEND information, advice and support service finder routes families to their local service. Check how to contact the service, who it supports and its current waiting times. Mediation providers, legal-aid advisers and specialist education solicitors have different roles; confirm which help is available for your issue.
